RELEASES
User agrees to release any and all claims against the Company, it(s) parent company(ies), subsidiaries, affiliates, shareholders, officers, directors, employees (past and present), successors, predecessors, assigns and agents including, but not limited to ParentTime.Net (collectively, "Releasees"), as more fully set forth below.
User hereby irrevocably and unconditionally releases, acquits and forever discharges the Releasees, and each of them, from any and all charges, complaints, claims, liabilities, obligations, promises, agreements, controversies, damages, actions, causes of action, suits, rights, demands, costs, losses, debts and expenses (including attorneys' fees and costs actually incurred) of any nature whatsoever, known or unknown, suspected or unsuspected, including without limitation, rights arising out of alleged violation of any contracts, express or implied, any covenant of good faith and fair dealing, express or implied, or any tort, including without limitation defamation, invasion of privacy, intentional or negligent infliction of emotional distress, wrongful discharge in violation of public policy, or any legal restrictions on the Company's business operations, or any federal, state or other governmental statue, regulation, or ordinance, including without limitation: (1) Title VII of the Civil Rights Act of 1964 (race, color, religion, sex and national origin discrimination); (2) 42 U.S.C Section 1981 (discrimination), but excluding any claims under this Agreement (collectively, "User Claims"), which User now has, owns or holds, or claims to have, own or hold, or which User at any time previously had, owned or held, or claimed to have, owned or held.
Nothing in this Agreement or the site shall be construed as an admission of liability by or against the Company and/or the Releasees.
DISCLAIMERS
All material in this site are provided "as is" and without warranties of any kind, either expressed or implied.
The information and software on this site is a management tool to coordinate and facilitate co-parenting and is not intended to be a substitute for professional legal or health advice. You may not rely on the information presented in this site as your sole source of information on any topic; your reliance on and use of site information and content shall be used at your own risk.
LEGAL VENUE
This Agreement is governed by and construed in accordance with the laws of the State of Michigan, irrespective of Michigan's choice-of-law principles. If you use this site from outside the United States, you are solely responsible for compliance with your local laws.
ARBITRATION
The prevailing party(ies) in any litigation, arbitration, mediation, bankruptcy, insolvency or other proceeding ("Proceeding") relating to the enforcement or interpretation of this Agreement may recover from the unsuccessful party(ies) all costs, expenses, and actual attorney's fees (including expert witness and other consultants' fees and costs) relating to or arising out of (a) the Proceeding (whether or not the Proceeding proceeds to judgment), and (b) any post-judgment or post-award proceeding including, without limitation, one to enforce or collect any judgment or award resulting from the Proceeding. All such judgments and awards, shall contain a specific provision for the recovery of all such subsequently incurred costs, expenses, and actual attorney's fees.
Any controversy or claim related to this agreement shall be settled in Kalamazoo, Michigan by arbitration in accordance with the American Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction. The arbitrator(s) shall not have the authority to award punitive damages against any party(ies) to this agreement. By using this site you are agreeing to have any dispute arising out of this Agreement decided by neutral arbitration as provided by California Law and you are giving up any rights you might possess to have the dispute litigated in a court or jury trial.

ParentTime.Net is an online co parenting management service designed to provide an easy way for our members to parent thier childern. To accomplish this, our members create their own profiles and our patent pending technology provides them with tools to co parent childern. In order to do this, we must ask for certain personal information.
We are a membership-based service. We collect credit card, address, or bank information only from those who choose to join.
Information Collected/Tracked
Surveys & Contests: From time-to-time our site requests information from users via surveys or contests. Participation in these surveys or contests is completely voluntary and the user therefore has a choice whether or not to disclose this information. Information requested may include contact information (such as name and shipping address), and demographic information (such as zip code, and age).
Except where you are expressly informed otherwise or as described immediately below, we do not sell, rent, share, trade or give away any of your personal information except to the financial institution that processes your credit card or check transaction unless required by law or for the protection of your membership.

Company takes every precaution to protect our users' information. When users submit sensitive information via the website, your information is protected both online and off-line.

You hereby authorize Company to charge your credit card in advance for all applicable fees incurred by you or on your behalf in connection with your use of the Company product or service you have chosen to use. You shall be solely responsible for all charges, fees, duties, taxes, and assessments arising out of your use of this site.
Monthly Recurring Billing: Your credit card will be billed on a monthly recurring basis. If you do not wish to have your credit card billed at the end of your monthly subscription service, you must cancel your subscription within that time period. Your monthly subscription charge is non-refundable, however, you may cancel your subscription at any time by going to the membership information page and hitting the "cancel" button located within your Payment History Box. If you have any questions about our billing policy, please send an inquiry to billing@parenttime.net .
Credit Card Payments Are Non-Refundable: When you chose to subscribe to the service and make a credit card payment to pay for the service, the subscription fee is non-refundable. However, if you wish to cancel your account, you may do so by notifying ParentTime.Net of your request to cancel membership via e-mail at info@parenttime.net. Your account will be canceled and your credit card will no longer be charged.
Grant Of License: Company does not claim ownership of the materials you provide to this site (including feedback and suggestions) or post, upload, input or submit in connection with your use of this site. However, you grant Company a royalty-free license to use (including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, sublicense and reformat your submission, and to publish your name in connection with your submission) your submission only in connection with the operation and promotion of this site.
Storage, Messages And Other Limitations: The amount of storage space may be limited. Some messages or photots may not be processed due to space constraints or outbound message limitations. You agree that Company is not responsible or liable for the deletion of or failure to store messages or other information.
Termination: Your subscription to this website may be immediately terminated for cause including, without limitation, your breach of applicable terms of use or your failure to remit any applicable subscription fee when due. Company may terminate your subscription to this web without cause by providing you with thirty (30) days prior written notice, including, without limitation, notice given by electronic mail of such termination.
Disclosure to Attorneys Client: The attorney agrees that they have authorization from their cleint to disclose their first and last name, their spouse's first and last name and their email address to Parenttime.Net. In addition, Parenttime.Net may require the case number. The email address of the client will be used for the sole purpose of assigning the relevant case and calendar information to the client for their future use for free pursuant to terms and conditions.
Sample Authorization for Use by the Attorneys:
Client/parent authorizes attorney to enter the following information into the database maintained by Parenttime.Net:
- First and Last Name of the Client
- Case Number
- Spouse First and Last Name
- Client email address
The above information shall only be used for the following purposes:
- The generation of ParentTime calendars
- Use in court proceedings
- Assignment of the calendar and required database information to the client/parent.
